Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Caravel PMS websites and services (the “Service”), provided by Kanav Systems Inc. (“Kanav”, “we”, “us”). “Caravel PMS” is a product name used by Kanav Systems Inc. By accessing or using the Service, you agree to these Terms.

1. Acceptance

By using the Service, you represent that you have authority to bind your organization (if applicable) and that you agree to these Terms on behalf of that organization.

2. Accounts and security

You are responsible for all activity under your account and for maintaining credential confidentiality.
You must provide accurate account information and keep it up to date.
You must promptly notify us of suspected unauthorized access or security incidents.

3. Subscriptions and billing

Paid plans, pricing, renewal terms, and included limits (such as property count) are described on the pricing page and/or in an order form. Unless otherwise agreed, subscriptions renew automatically until cancelled.

Fees: You agree to pay applicable fees and taxes.
Changes: We may update pricing with advance notice as required by law/contract.
Refunds: Refund policies (if any) should be stated in an order form or billing policy.

4. Acceptable use

You agree not to:

Access or use the Service in violation of applicable laws (including privacy and marketing laws).
Attempt to probe, scan, or test the vulnerability of any system or bypass security controls.
Transmit malware, spam, or abusive content through the Service.
Reverse engineer the Service except to the extent prohibited by law.

5. Customer data

“Customer Data” means data submitted to the Service by you or your users. You retain rights to Customer Data. You are responsible for ensuring you have appropriate rights and notices/consents to provide Customer Data.

To the extent we process personal information on your behalf, the parties may enter into a Data Processing Addendum (“DPA”) as required by applicable law.

6. Third-party services

The Service may integrate with third-party services (e.g., email/SMS providers). Your use of those services may be subject to their separate terms and policies.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL KANAV SYSTEMS INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KANAV SYSTEMS INC.’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO CARAVEL FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Termination

You may stop using the Service at any time and may cancel according to your plan terms.
We may suspend or terminate access for violations of these Terms or to protect the Service and users.
Upon termination, you may request export of Customer Data subject to contract/legal requirements.

10. Changes

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use after the effective date constitutes acceptance.
